1. Acceptance of Terms

By accessing or using Chess365 ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms. It is your responsibility to review these Terms periodically.

2. Description of Service

Chess365 provides a notification service that monitors publicly available chess tournament data from chess-results.com and sends email notifications to users about player results. The Service includes:

  • Tracking of chess tournament standings and results
  • Email notifications when tracked players complete games
  • A dashboard to manage tournament and player subscriptions

3. User Accounts

To use the Service, you must:

  • Be at least 16 years of age
  • Create an account using Google OAuth authentication
  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized use of your account

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use Policy

You agree NOT to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or servers
  • Use automated systems (bots, scrapers) to access the Service beyond normal use
  • Circumvent any access limitations or rate limits
  • Resell, redistribute, or commercially exploit the Service without permission
  • Impersonate any person or entity
  • Harass, abuse, or harm other users
  • Use the Service to send spam or unsolicited communications

5. Free Service and Limitations

Chess365 is currently provided free of charge. Free accounts are subject to the following limitations:

  • Maximum of 1 tournament tracked simultaneously
  • Maximum of 3 players tracked per tournament

We reserve the right to modify these limitations, introduce paid tiers, or discontinue the free service at any time with reasonable notice.

6. Third-Party Data and Content

The Service displays chess tournament data obtained from chess-results.com and potentially other third-party sources. This data includes player names, rankings, ratings, and game results that are publicly available.

Important:

  • We do not own or control third-party data sources
  • We cannot guarantee the accuracy, completeness, or timeliness of third-party data
  • Third-party data may be delayed, incorrect, or unavailable
  • Changes to third-party websites may affect Service functionality

Chess-results.com is an independent service not affiliated with Chess365. For official tournament results, always refer to the original source.

7. Intellectual Property

The Service, including its original content, features, and functionality (excluding third-party data), is owned by Chess365 and protected by international copyright, trademark, and other intellectual property laws.

Chess tournament data displayed through the Service remains the property of its respective owners. Player names, ratings, and results are public information published by tournament organizers.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We specifically disclaim:

  • Any warranty that the Service will be uninterrupted, timely, secure, or error-free
  • Any warranty regarding the accuracy or reliability of tournament data
  • Any warranty that notifications will be delivered promptly or at all
  • Any implied warranties of merchantability, fitness for a particular purpose, or non-infringement

You acknowledge that tournament data may be delayed, inaccurate, or unavailable, and you should not rely solely on the Service for time-sensitive decisions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHESS365 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or goodwill
  • Service interruption or computer damage
  • Cost of substitute services
  • Any damages arising from missed or delayed notifications
  • Any damages arising from inaccurate tournament data
  • Any matter beyond our reasonable control

In no event shall our total liability exceed the amount you paid for the Service (if any) in the 12 months prior to the claim, or $100 USD, whichever is less.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Chess365 and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or violation of any rights of a third party.

11. Service Modifications and Termination

We reserve the right to:

  • Modify, suspend, or discontinue the Service at any time without notice
  • Change features, functionality, or service limitations
  • Terminate your account for violation of these Terms
  • Terminate your account for any reason with reasonable notice

Upon termination, your right to use the Service ceases immediately. We may delete your account data in accordance with our Privacy Policy.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your personal data.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Chess365 operates, without regard to its conflict of law provisions. For users in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws in your country of residence.

14. Dispute Resolution

If you have a dispute with Chess365:

  1. Informal Resolution: First, contact us at contact@chess365.ai to attempt to resolve the dispute informally.
  2. Mediation: If informal resolution fails, both parties agree to attempt mediation before pursuing other remedies.
  3. Legal Action: If mediation fails, either party may pursue legal remedies in courts of competent jurisdiction.

For EU users: You may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and Chess365 regarding your use of the Service and supersede any prior agreements.

17. No Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative.
